Dear President Cyril Ramaphosa,
The African Solidarity Civic Organisation (ASCO) writes to you out of deep concern regarding the continued delay in making a decision on the reinstatement of the National Commissioner of the South African Police Service, General Fannie Masemola.
ASCO believes that justice delayed is justice denied. The prolonged uncertainty surrounding the leadership of the South African Police Service does not appear to serve the interests of justice or the people of South Africa. Instead, it creates a perception that instability within the SAPS benefits well-connected individuals whose interests may not align with those of the nation.
The evidence currently emerging before the Madlanga Commission of Inquiry has raised serious public interest issues. There is also a clear precedent that where compelling evidence of alleged misconduct has emerged before the Commission, the relevant authorities have acted decisively. It therefore raises legitimate questions as to why there has been no corresponding urgency in resolving General Masemola’s position.
The National Prosecuting Authority has indicated that it is reviewing the charges against General Masemola. However, the constitutional principle of fairness requires that legal processes be conducted without unnecessary delay. Justice must not only be done; it must also be seen to be done.
It is important to note that General Masemola has not been accused of corruption or of colluding with individuals allegedly involved in fraud and corruption. The allegations against him relate to alleged negligence or oversight. In these circumstances, ASCO is of the considered view that the matter should not have remained unresolved for such an extended period, particularly in light of the developments at the Madlanga Commission of Inquiry.
Mr President, South Africans deserve confidence that decisions are made impartially and in the public interest. Any delay that creates the perception that certain individuals are being protected risks undermining public trust in both the Presidency and the criminal justice system.
ASCO further wishes to raise concern regarding the financial implications of the current arrangement within the Ministry of Police. The public deserves clarity on how long taxpayers will continue funding two Ministers of Police—one reportedly not performing active executive duties while another carries out the responsibilities of the office. At a time when South Africa faces severe economic challenges, every rand of public expenditure must be carefully justified.
We also respectfully remind you of your commitment, made when you assumed the Presidency following the recall of former President Jacob Zuma, to establish a leaner and more efficient executive. At the time, you criticised the size and cost of the Cabinet and committed yourself to reducing unnecessary expenditure. The current situation appears inconsistent with that commitment and understandably raises questions among South Africans.
Leadership often requires making decisions that may be popular with some and unpopular with others. Nevertheless, decisive leadership is essential to preserving public confidence in our democratic institutions. The Presidency should be seen as acting in the interests of all South Africans, rather than in the interests of a select few.
ASCO therefore respectfully calls upon you to:
● Expedite a decision regarding the status of General Fannie Masemola in accordance with the law and the principles of administrative justice.
● Provide the nation with clarity on the reasons for the continued delay.
● Ensure that public resources are utilised efficiently and that unnecessary expenditure is avoided.
● Continue demonstrating your commitment to accountable governance, transparency and the rule of law.
South Africa deserves a police service led with certainty, stability and integrity. The public also deserves confidence that justice is administered fairly, consistently and without unnecessary delay.
