During July 2021, former President Jacob Zuma was arrested after the Constitutional Court found him in contempt of its order. His arrest sparked widespread public debate and political reactions. Among those who expressed concern was the leader of the Economic Freedom Fighters (EFF), who publicly cautioned President Cyril Ramaphosa to intervene in a manner that could prevent unrest and its potentially devastating consequences. Those warnings were not acted upon, and South Africa subsequently experienced widespread unrest that resulted in significant loss of life, destruction of property, and severe economic damage.

The African Solidarity Civic Organisation (ASCO) does not promote lawlessness and firmly maintains that no individual is above the law. At the same time, we believe that national leaders have a constitutional and moral responsibility to make decisions that safeguard the interests of the country and its people, particularly where there is a foreseeable risk of instability.

ASCO is concerned that South Africa may once again be heading towards avoidable tensions if the President and his Cabinet do not carefully assess the current situation involving the Independent Directorate Against Corruption (IDAC) and members of the South African Police Service (SAPS).

While we fully support the principle of accountability and the rule of law, questions have been raised in the public domain regarding the timing and manner of certain investigations and prosecutions involving members of SAPS. Furthermore, the plea agreement and proposed sentence in the case involving an individual accused of attempting to murder his girlfriend have also attracted public scrutiny. These developments have contributed to growing public perceptions that require careful and transparent consideration.

We therefore respectfully call upon the President of the Republic of South Africa to review the current circumstances and ensure that all state institutions operate impartially, transparently, and without any perception of selective enforcement. Public confidence in the justice system depends on the equal application of the law, free from political influence or personal interests.

ASCO believes that no one is above the law and that every person must be treated equally before the law. However, we also believe that those entrusted by the Constitution with the responsibility of protecting the Republic and its people must exercise sound judgment, act proactively, and take all reasonable steps to prevent conflict and preserve national stability.

Our appeal is not for anyone to be shielded from accountability, but for responsible leadership that prioritises justice, peace, and the protection of all South Africans. We urge government to act decisively and wisely to prevent any circumstances that could lead to a repetition of the tragic events witnessed during the July 2021 unrest.
